These Terms of Use (“Terms”) govern your access to and use of the website located at www.philadelphiamasonrycompany.com (the “Site”), operated by Philadelphia Masonry Company (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site.

1. Lead Generation Services Only

The Site is a marketing and lead-generation platform. Its purpose is to provide information about masonry services and to connect homeowners and property owners in Philadelphia, Pennsylvania and the surrounding areas with independent masonry contractors. We are not a masonry contractor, and we do not perform brick pointing, masonry repair, restoration, stucco, or any other construction or repair work ourselves. Any request you submit through the Site — including through a contact or “free estimate” form — is an inquiry that may be shared with one or more independent contractors so they can follow up with you directly.

2. Independent Contractor Relationship

All masonry, repair, restoration, stucco, and related services described on the Site are performed by independent, third-party contractors who are licensed, insured, and bonded as required by applicable law. These contractors are not our employees, agents, partners, or joint venturers. We do not supervise, direct, or control the work they perform, and any agreement for services is solely between you and the contractor. You are responsible for evaluating, selecting, and contracting with any contractor, including verifying their licensing, insurance, qualifications, pricing, and suitability for your project.

3. No Endorsement or Warranty

Information on the Site is provided for general informational purposes only and is offered “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not endorse, guarantee, or warrant the work, conduct, pricing, timeliness, or results of any contractor, and we make no representation that any contractor is appropriate for your needs. We do not warrant that the Site will be accurate, complete, current, uninterrupted, or error-free.

4. Limitation of Liability

To the fullest extent permitted by law, Philadelphia Masonry Company and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Site, your reliance on any information on the Site, or any interaction, agreement, or work involving a contractor introduced through the Site. This applies whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages. The quality, safety, and outcome of any masonry work are the sole responsibility of the contractor you hire.

5. Indemnification

You agree to indemnify, defend, and hold harmless Philadelphia Masonry Company and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or any dispute between you and a contractor introduced through the Site.

6. Prohibited Uses

You agree not to use the Site to:

  • Violate any applicable law, regulation, or ordinance;
  • Submit false, misleading, or fraudulent information or requests;
  • Infringe or misappropriate the intellectual property or privacy rights of others;
  • Transmit any viruses, malware, or other harmful code, or attempt to gain unauthorized access to the Site or its systems;
  • Use any automated means to scrape, harvest, or collect information from the Site without our written permission;
  • Interfere with or disrupt the operation of the Site or the servers and networks used to make it available.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, layout, and design — is the property of Philadelphia Masonry Company or its licensors and is protected by applicable intellectual property laws.
